The Elements of a Tort
In order for a tort to have been committed, four elements must be in place. The elements are:
- The presence of a duty. A duty is a form of legal obligation, the breaking of which can lead to physical harm.
- The breach of the duty. A duty has been breached when the actions of the defendant have not lived up to the expected standard of care.
- An injury. An injury must have occurred, resulting in physical or emotional damage.
- Causation. The injury must have been caused directly by the breach of duty in question.
